结婚证撕了可以离婚吗？如果结婚证被撕掉，可以离婚「分享」

　　如果结婚证被撕毁，可以离婚。只需重新申请结婚证，到原申请结婚证的地方，重新申请离婚即可。

　　婚姻法第三十一条　男女自愿离婚的，准予离婚。双方必须向婚姻登记机关申请离婚。当婚姻登记机关发现双方确实自愿并妥善处理子女和财产问题时，应当颁发离婚证书。

　　第三十二条　男女一方要求离婚的，有关部门可以调解或者直接向人民法院提起离婚诉讼。在审理离婚案件时，人民法院应当进行调解；如果感情确实破裂，调解无效，就应该允许离婚。

　　结婚证是夫妻合法婚姻的重要证明文件，是婚姻关系的证明和保障。但有些夫妻在分手时，会撕掉或烧掉结婚证，认为这样可以解除婚姻关系。这种行为没有法律效力。

　　结婚证是国家法定的婚姻公证书，只有通过法律手段才能解除婚姻关系。即使结婚证被毁，只要婚姻关系未经法院判决或协议离婚，夫妻关系仍然存在，仍然是法律婚姻。因此，夫妻要想解除婚姻关系，就必须按照法律程序离婚。

　　夫妻双方在离婚过程中可以选择和平离婚或诉讼离婚。和平离婚是指夫妻在没有争议的情况下通过办理离婚手续达成离婚的自愿协议。诉讼离婚是指夫妻不能达成协议或者重大违反婚姻法律法规的，由法院判决离婚的方式。

　　在诉讼离婚中，法院将根据夫妻双方的意愿和事实证据，作出是否离婚、离婚后财产分割、子女抚养等判决。离婚判决书是夫妻解除婚姻关系的法律证明文件，取代了结婚证的作用。所以，即使结婚证被撕掉，离婚判决书仍然具有法律效力。
